BOOKING AGREEMENT - STANDARD TERMS AND CONDITIONS

These terms contain the entire understanding between the "Client(s)" and Alan Rogers Photography, hereinafter referred to as the "Photographer(s)." Refer also to email/SMS communications between the parties regarding any exclusions, inclusions, and/or special arrangements. A deposit/retainer is due upon booking, and the balance is due two weeks prior to the wedding unless otherwise agreed.

Cooperation: The Clients and the Photographer consent to cooperating and communicating with each other to achieve the best possible result within the understanding of this agreement. The Clients also agree to give the Photographer sufficient warning of key events at the wedding to allow time to prepare (e.g., bouquet throwing, cutting the cake, speeches, dances, etc.). Please note that not all guests at weddings like having their photo taken. In such cases, the Photographer will use discretion but cannot be held responsible for a lack of photos of these individuals. In the spirit of cheerful cooperation, the Clients agree to give the Photographer precedence over the guests to take the photographs required for the wedding services described above. The Photographer cannot be held liable for a lack of wedding photos if guests taking their own photos of the Clients continually interrupt the Photographer's work.

House Rules: Photographers are sometimes limited by rules imposed by registrars, church ministers, and venue management regarding what can and cannot be done. For example, some church ministers insist that no flash photography is allowed, while others request that the Photographer shoot from a specific location. In such circumstances, the Clients agree to accept any technical limitations imposed on the Photographer and the equipment used. We advise the Clients to familiarize themselves with the venue's rules and, if necessary, negotiate with the relevant personnel.

Style: The Clients acknowledge that the Photographer requires and retains discretion regarding how services shall be provided (e.g., choice of poses, lighting, lenses, etc.). The Clients confirm they are familiar with the Photographer's portfolio and are requesting services with knowledge of the Photographer's style. They understand that the Photographer's work is constantly evolving and that the services are of a unique nature. In creating the images, the Photographer shall use their personal judgment to produce images consistent with their vision of the wedding, which may differ from the Clients’ expectations. Accordingly, the Clients acknowledge that the images shall not be subject to rejection based on taste, aesthetic criteria, or personal appearance.

Delivery: Images and videos are edited in-house by the Photographer and may take up to eight weeks from the date of capture for full completion. In the unlikely event of a delay, the Clients will be notified and provided with a new estimated completion date. All images and videos are supplied in industry-standard formats (.jpg/.mp4) at the highest possible resolution and are free of any watermarks.

Copyright: As per industry standards, the copyright of all images and videos remains with the Photographer. The Photographer grants the Clients permission to make copies under the following conditions: The images and videos taken by the Photographer are for personal use by the Clients, their friends, and relatives. Sale, publication, or any commercial use of the photographs/videos is not permitted without prior written permission from the Photographer.

Model Release: The Clients grant the Photographer and its legal representatives, heirs, and assigns the irrevocable and unlimited consent to use the photographs/videos for social media, editorial, competitions, and advertising purposes, to alter the photographs/videos without restriction, and to copyright the images/videos. The Clients hereby release the Photographer and its legal representatives, heirs, and assigns from all liability and claims in connection with the images/videos.

Cancellation: If these terms and conditions are not met by the Clients, in part or in full, or if the Clients cancel the wedding for any unreasonable reason (e.g., change of mind), the retainer/deposit is non-refundable. It will be considered liquidated damages to help offset the loss of business to the Photographer. The Photographer will work with the Clients to organize another date and time and may, at its discretion, hold the retainer/deposit as a credit for a future wedding date, provided the Photographer is not already booked or unavailable for any reason on that date.

Limit of Liability: If the Photographer is too ill, becomes injured, or is unable to supply the agreed wedding services due to circumstances reasonably beyond their control, the Photographer will make extreme efforts to find a replacement. If a replacement cannot be arranged in time, a full refund of all payments already received will be made within seven days. The Photographer has working methods in place to prevent loss or damage to images; however, there is a highly unlikely possibility that images may be lost, stolen, or destroyed for reasons beyond the Photographer's control. In such circumstances, liability is limited to the return of fees paid for the service or part thereof, according to the percentage of images already supplied.

By submitting this booking agreement, the Client confirms that they have read, understood, and agree to the terms herein.
